The Trump administration Friday overturned an Obama-era dictate that banned discrimination against patients based on gender individuality. The regulation from the HHS' Office for Civil Rights drops protections based on gender individuality from the ACA's chief anti-discrimination provision. OCR similarly ended nondiscrimination protections for LGBTQ people by modifying other CMS rules, including standards for qualified health plans and the ACA marketplaces, even though they're not related to and predate the OCR rule. When the agency proposed the changes, it expected half of all covered entities to ditch their gender and sexual-orientation nondiscrimination policies as a result. (Brady, 6/12)

The timeline below is not comprehensive but is representative of the tremendously harmful efforts taken by this administration — which are deeply impacting our communities and devastating people’s lives, families, and futures. These behavior seek to create chaos, sow division, and roll back critical civil and human rights and protections. Nevertheless, the civil rights community persists in pushing back to defend and advance rights and freedoms for all.

Notably, the administration has installed the president’s personal attorneys and other anti-civil rights extremists into positions responsible for enforcing landmark civil rights laws, including at the Department of Justice and its Civil Rights Division, where political appointees have perverted the founding mission of the division — devoting themselves to promoting the president’s dangerous authoritarian, anti-civil and human rights agenda that targets our nation’s most vulnerable people and communities. The Trump Administration’s Terminal Rule on Section 1557 Non-Discrimination Regulations Under the ACA and Current Status

On June 19, 2020, the Trump Administration issued final regulations implementing Section 1557 of the Affordable Care Act. Section 1557 prohibits discrimination based on race, color, national inception, sex, age, and disability in health programs and activities receiving federal financial assistance. Notably, it is the first federal civil rights law to prohibit discrimination in health care based on sex. The concluding rule, issued in the midst of the ongoing COVID-19 pandemic, significantly narrows the scope of a rule issued in 2016 by the Obama Administration by:
  • Eliminating the general prohibition on discrimination based on gender identity and sex-stereotyping and specific health insurance coverage protections for transgender individuals;
  • Adopting blanket abortion and religious freedom exemptions for health nurture providers;
  • Eliminating the provision preventing health insurers from varying benefits in ways that discriminate against certain groups, such as people with HIV or LGBTQ people;

    July 23, 2020: The Department of Housing and Urban Training formally announced the rollback of a previous command that protected transgender people from discrimination by homeless shelters and other housing services receiving federal funds.
